1. Seller and contact details

Giovenza is the trading name of SHORTIQLAB STUDIOS ECOM - FZCO, FZCO licence/registration 88880, Building A1, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates. Contact info@giovenza.com or +39 350 990 6974 for orders, complaints and consumer rights. The registered office is not automatically the returns warehouse; do not send goods there without specific instructions.

2. Scope and applicable version

These conditions concern distance sales of shoes, sneakers, clothing, jeans, hoodies, T-shirts, jackets and accessories to individuals acting outside their profession. Mandatory protections of the destination market prevail over conflicting terms. The version provided and accepted when ordering applies to that contract; later revisions do not retrospectively change it. The revision date does not certify compliance with future 2027 legislation.

3. Products, brands and sizes

The individual listing must state the actual model, size, colour, composition, characteristics and availability. Size guides assist selection but do not change the ordered variant or exclude conformity rights. Screen differences do not excuse a materially different product. A brand reference does not establish affiliation, authorised distribution, certified authenticity or a manufacturer guarantee; specific statements require evidence. Only lawful, safe products respecting intellectual property may be sold. These terms do not legitimise counterfeit goods.

4. Prices and total charges

WooCommerce catalogue prices and availability are checked before purchase. No legacy store discounts or delivery thresholds apply automatically. Before a binding order the currency, total, applicable taxes, shipping and known extra charges must be disclosed. Where a charge cannot reasonably be calculated in advance, the calculation method and potential charge must be explained. Optional paid extras cannot be preselected. Announced EU price reductions must comply with national prior-price rules, generally the lowest price in the preceding 30 days, subject to lawful exceptions.

5. Ordering and contract formation

Customers select variants and quantities, review the basket and delivery details, and correct errors before final submission. Once purchases are enabled, the final command must unambiguously state the obligation to pay. An automated acknowledgment of a request is not necessarily acceptance: contract acceptance must identify the seller, goods, total and terms in a retainable communication. An accepted contract cannot be arbitrarily cancelled through a broad stock reservation; genuine errors and inability to fulfil are dealt with under applicable law and sums due are returned.

6. Current payment status

Checkout is currently a preview: it does not conclude purchases or charge customers. Stripe, SumUp and other unconfigured providers are not activated. Card or credit-provider logos are not proof that those services or instalment offers are available. Before sales open, only configured, tested methods and their applicable terms may be offered. Never send full payment-card details to support. A saved basket or technical recovery record is neither a purchase confirmation nor proof of payment.

7. Accounts, wishlist and basket recovery

Accounts support profile, wishlist and orders associated with a verified identity. An account is not required to notify withdrawal or complain. Customers should safeguard credentials and supply accurate details; the seller must protect order access. Abandoned-basket storage remains separate from payment and supports requested service continuity; it does not automatically authorise newsletters, advertising or customer-list uploads. Promotional communications require a distinct lawful basis and compliance with applicable law.

8. Delivery and risk

Available destinations, costs, method and agreed delivery date or interval must be provided before payment. There is no general 24/48-hour promise. For EU consumers, unless otherwise agreed, delivery must occur without undue delay and within 30 days of contract formation. Risk passes upon physical possession by the consumer or their nominated non-carrier third party, subject to the statutory exception for an independently appointed carrier not offered by the seller. Loss or damage beforehand is not shifted to the consumer.

9. EU withdrawal and exchanges

EU consumers normally have 14 calendar days after delivery to withdraw without a reason, including ordinary shoes and clothing and discounted products. The voluntary 48-hour shoe policy and lack of discretionary clothing exchanges do not restrict that right. Use “Withdraw from contract here” on Returns, also accessible from the footer, or email or another unequivocal statement. See Returns for deadlines, statutory exceptions and refunds. A voluntary size exchange and a defective-goods remedy are separate from withdrawal.

10. UAE consumers and voluntary policy

For UAE customers, the voluntary change-of-mind policy permits shoe return requests within 48 hours of delivery and does not offer clothing/accessory returns or exchanges merely for a change of mind or a customer-selected wrong size. These are only additional commercial terms: mandatory UAE remedies for defective, damaged, wrongly supplied or non-conforming goods and other protected circumstances remain unaffected. The EU 14-day rule is not represented as a general UAE statutory withdrawal period. Applicable federal protections also cover free zones unless specifically excluded by law.

11. Legal conformity guarantee

For EU consumer sales, the seller is liable for lack of conformity appearing within at least two years after delivery, subject to longer national protections and local rules on proof and limitation. Repair or replacement are free, within a reasonable time and without significant inconvenience; price reduction or termination apply in statutory circumstances. A 48-hour or seven-day contractual notice limit cannot remove these rights. Normal wear or customer-caused damage is not automatically an original defect. Mandatory UAE remedies apply to UAE sales. No additional commercial guarantee is promised without documented terms.

12. Complaints and disputes

Contact the seller with the order reference and issue; withdrawal requires neither reasons nor discretionary approval. Operational response times are not invented and do not suspend legal deadlines. Amicable resolution is optional and does not waive access to courts, authorities or available remedies. A UAE governing-law choice cannot deprive EU consumers of applicable mandatory home-country protections or consumer jurisdiction. Exclusive Dubai arbitration is not imposed. The former EU ODR platform closed in 2025 and is not offered as an available service.

13. Liability and changes

No term excludes responsibility for fraud, wilful misconduct, gross negligence, death or injury, safety duties or other non-excludable obligations. A general order-value cap is not imposed where unlawful. Invalid terms do not cancel remaining protections. Browsing does not accept an unformed purchase contract; privacy and optional tracking consent are distinct from contract acceptance. Updated terms must remain accessible and retainable.

Legal sources and checks before sales

Sources reviewed: EU Directives 2011/83, 2019/771, 2023/2673 and 2024/825; GDPR; UAE Federal Law 15/2020, Cabinet Resolution 66/2023, Decree-Law 14/2023 and PDPL 45/2021. National implementing rules and later amendments prevail. UAE consumer information and invoices require Arabic; Italian/English pages do not fulfil that requirement. Return address, tax/customs model, transfer safeguards, required EU representation and the harmonised legal-guarantee notice applicable from September 2026 remain to be checked. Sales/payments remain disabled until these requirements are completed.
